Turns out Timberlake and Will I Am sampled legally, paying and acknowledging Davis on the album. This sample was not lifted wholesale without any acknowledgement, which is what most of the comments are presuming. Please read the court case. The dispute is with another party (not Davis!!), and this party claims to be the legal owner of the sample, but their claim of ownership itself is being hotly contested.
I always thought ‘Damn Girl’ was a standout on the Futuresex/Love Sounds album. They paid for using it, but the main writer wasn’t credited or paid, I believe.
They are going to settle out of court to save face. That way they will not have the tag attached= stolen from JC Davis asterisk. Like the one attached to Vanilla Ice
I do hear the whole instrumental used for "Damn Girl" and the only difference is JT's lyrics on it. However, when you check the credits given in Futuresex/Lovesounds under Damn Girl, J.C. Davis is surely given credit for. I do realize that this is more than a sample since the whole song was used and on top of that the beat was manipulated with back and forth and also the electric guitar was taken out. Although the credit was given I just personally felt like Will.i.am shouldn't have trampled with the beat like that. Will.i.am is nowhere near a decent producer let alone a decent sampler. It's sad cause I've always loved this song and now I've heard the original one, I prefer the original one million times more.
